The Ex Parte Application and Motion are filed the morning of your Ex Parte Hearing. You must file with the clerk by the time listed & be on time to the courtroom for your emergency hearing. In this document, you or someone else will swear to the Court that you have mailed a copy of the ex parte application to the opposing counsel or unrepresented party. Per Local Rule 700.7, ex-parte requests filed by represented parties must be filed electronically using the court’s electronic service providers, unless the court excuses parties from doing so. Temporary emergency (ex parte) orders are needed to: (a) help prevent an immediate loss or irreparable harm to a party or to children in the case, (b) help prevent immediate loss or damage to property subject to disposition in the case, or (c) set or change procedures for a hearing or trial. What is an “Ex Parte” Review? An ex parte review is a federal requirement for MA and CHIP renewals which avoids unnecessary requests for verification from the client when the information is already available through other data sources and the existing case record. Communication between the court and counsel (or other interested person) when opposing counsel has neither notice nor an opportunity to respond is a prohibited ex parte communication. An emergency ex parte order is in the best interests of the child or children because there is an immediate and present risk of physical danger or psychological harm to the child or children named in this application.
